From what is said we see abundantly, that this earth, and all it contains, was placed by God in that state the moralists call negative community, and not positive. The negative is „the state of things not yet in property, but lying open to the occupation of any one.“ Positive community is the “state of things HowProperty is acquired. 331 „in which not any individual but a whole society haveChap. 7.an undivided property.“ Goods in this positive community neither any individual member of the society, nor any other, can occupy or dispose of without consent of the whole society, or those who govern it. Now from the preceeding reasons 'tis plain, that any man could acquire property, and see his right to acquire any thing he first occupied, without consulting the rest of mankind; and it would be injurious in any other person to hinder him. Thus we need not have recourse to any old conventions or compacts, with Grotius and Puffendorf, in explaining the original of property: nor to any decree or grant of our first pa rents, with Filmer.

Aus dem Angeführten erhellt sattsam, daß diese Erde und was darauf ist, von Gott in den Stand gesetzt worden sey, welchen die Moralistendie negative Gemeinschaft, und nicht die po sitive, nennen. Die negative ist „der Zustand der Dinge, die noch niemand eigenthümlich zuge hören, sondern der Besitznehmung eines jeden überlassen sind.“ Die positive Gemeinschaft ist „der Zustand der Dinge, an welchen keine ein zelne Person, sondern eine ganze Gesellschaft ein unzertheiltes Eigenthum hat.“ Die Güter in dieser positiven Gemeinschaft kan weder dieses noch ein anders einzelnes Mitglied der Gesellschaft, ohne die Einwilligung der ganzen Ge sellschaft und derjenigen, welche sie regieren, in Besitz nehmen, noch Gebrauch davon machen. Nun ist aus den vorherangeführten Ursachen klar, daß ein Mensch das Eigenthum erlangen und sein Recht, sich dasjenige, was er zuerst in Besitz ge nommen, zuzueignen, gewahr werden kan, ohne die das Eigenthum zu erlangen. 487Siebenter Abschnitt. übrigen Menschen darum zu befragen; und es würde eine Beleidigung von einer andern Person seyn, ihn hierinnen zu hindern. Wir haben also nicht nöthig, mit Grotius und Pufendorf, bey der Erklärung des Ursprungs des Eigenthums, zu alten Vergleichen und Verträgen oder mit Filmer, zur Erlaubnis unsrer ersten Aeltern unsre Zuflucht zu nehmen.
